This Privacy Policy describes and applies to the information Balance Hormone
Center, LLC (“Balance Hormone Center”, “we”, “us”) collects from you when you
use our voice, mobile device and desktop platforms, tools and applications,
balancehormonecenter.com and our other websites (collectively the “Services”),
how we use that information, and when we disclose it. It also explains how to
manage the personal information you provide to us through the Services.

This policy applies only to information you provide to us online while visiting
or using our Services. It does not apply to information we have obtained or may
obtain offline through other traditional means, and it does not apply to
third-party applications that integrate with the Services.

Balance Hormone Center separately maintains a Notice of Privacy
Practices, as required by law, which applies to protected health
information. Text messaging is governed by this policy together with the terms
for each program: our
SMS Terms & Conditions for appointment messages
and our
SMS Terms & Conditions for patient messages.

1. The information we collect

When you use our Services we receive and collect certain information. What we
receive depends on what you do when you use the Services.

Automatically collected information

Some information is received automatically when you use the Services. This may
include: the name of the domain and host from which you access the Internet,
including the Internet protocol (IP) address of the computer you are using and
the IP address of your Internet Service Provider; the type and version of your
browser software and operating system; the type and version of your media
player(s); the date and time you access our Services, the length of your visit,
and the specific pages, images, video or forms you access; the Internet address
of the website from which you linked directly to our Services and, if
applicable, the search engine that referred you and any search terms you
entered to find the Services; and demographic information concerning the
country of origin of your computer and the languages it uses.

We use this information to monitor usage of our Services, assess performance,
ensure technological compatibility with your computer, and understand the
relative importance of the information we provide. We may also use this data to
conduct statistical analyses of visitor usage patterns and other aggregated
data.

Information collected via cookies

Cookies are small files or records placed on your computer to distinguish you
from other visitors using the Services. The use of cookies is a standard
practice among websites to collect or track information about your activities.
Balance Hormone Center Services use session cookies, which are removed from
your computer after you close your browser.

Browsers are typically set to accept cookies, so most people do not realize
cookies are being placed on their computers. You can choose to have your
browser warn you each time a cookie is sent, or turn off cookie placement
entirely. If you refuse cookies you can still use our Services, but your
overall experience may be affected and some functionality may be reduced or
unavailable.

Pixel tags and clear GIFs

Pixel tags and clear GIFs, also known as web beacons, are transparent
graphical images placed on a website. Balance Hormone Center does not
currently use them on its site.

Information you actively submit

For most activity on our Services we neither require nor collect “User
Information” — information that could personally identify you, such as your
name, email address, billing address, phone number, or payment card
information. You can browse our Services and review our services without
submitting any User Information.

User Information is required when you want to:

request or schedule an appointment at a Balance Hormone Center location;
complete patient intake or other patient forms;
submit a job application;
send us an email or otherwise provide online comments, questions,
suggestions or feedback;
participate in a chat session; or
receive text messages from us, as described in Section 2 below.

We do not require you to provide personal medical information about yourself
through the Services, and we ask that you not share personal medical
information through the Services — especially information you wish to keep
confidential. Information you provide through our Services is not protected
under the confidentiality laws that protect physician-patient communications.
Please select carefully what you choose to disclose. While Balance Hormone
Center works to prevent unauthorized access to our Services, such access may
occur. Personal medical information that Balance Hormone Center receives in
any manner is subject to our separate Notice of Privacy Practices.

2. Mobile phone numbers and text messaging

If you choose to provide a mobile phone number, we use it to contact you about
your care and your appointments. Providing a mobile number is optional, and
consent to receive text messages is never a condition of purchase or of
treatment.

Where you have given consent, we use your mobile number to send appointment
reminders, appointment confirmations, and notices about appointment changes or
cancellations. Message frequency varies. Message and data rates may apply. You
can reply STOP at any time to stop receiving text messages, or HELP for help.

We operate a second, separate text message program for patient messages. Where
you have given consent to that program, we use your mobile number to send you a
secure link to a form we have asked you to complete, or to a summary of a visit.
Opening the link asks you to confirm your date of birth first; the message
itself contains no clinical information. This program is separate from
appointment messages: you consent to each one on its own, and you may opt out of
either without affecting the other. Message frequency varies. Message and data
rates may apply. Reply STOP to opt out or HELP for help. Consent is not a
condition of purchase or of treatment. Full program details are in our

No mobile information will be shared with third parties or affiliates for
marketing or promotional purposes. Information sharing to subcontractors in
support services, such as customer service, is permitted. All other use case
categories exclude text messaging originator opt-in data and consent; this
information will not be shared with any third parties.

We retain a record of your text messaging consent — including when and how it
was given, and when it was withdrawn — so that we can honor your choice and
demonstrate that we did.

Employment and recruiting text messages

Separately from patient communications, we collect mobile telephone numbers from job applicants, candidates, and employees who choose to provide them on an employment application, in onboarding documentation, or directly to our Human Resources team. Where you have given consent, we use your mobile number to send one-on-one Human Resources and recruiting messages, including interview scheduling, application and offer communications, onboarding and benefits information, and responses to employment-related questions you raise with us.

We do not use these numbers for marketing or promotional messaging. You may opt out at any time by replying STOP. Opting out does not affect your application or your employment. Terms governing this program are published at our HR & Recruiting Text Message Terms & Conditions.

3. How we use and share User Information

When you actively submit User Information through the Services, we will use
that information in one or more of the following ways:

to process, complete, or otherwise act upon or respond to your request or
the reason you submitted the information;
to register and/or verify you in connection with a service or feature you
are attempting to access or obtain;
to communicate with you about your request;
to provide additional information to you about Balance Hormone Center and
its services that we believe may interest you;
to study and analyze the use of the information and features available on
our Services; and
where necessary, to protect our rights or property, enforce this Privacy
Policy, and prevent harm to you or others.

We do not sell User Information to third parties. Except
where we obtain your express permission, we share User Information with third
parties only under the limited circumstances below. Mobile phone numbers and
text messaging consent are additionally restricted as described in Section 2.

Payment processors receive payment card information only to verify the card
and process a transaction.
User Information is disclosed to service providers where necessary to
process a particular request you have made — for example, scheduling or
billing — under contracts that restrict their use of it.
User Information submitted with a job application may be disclosed to third
parties to conduct background checks, verify prior employment, check
references, and for other lawful purposes reasonably necessary to our
interviewing and hiring process.
User Information is subject to disclosure in response to judicial or other
governmental subpoenas, warrants and court orders served on Balance Hormone
Center in accordance with their terms, or as otherwise required by
applicable law.
User Information is subject to disclosure to protect our rights or property,
to enforce this Privacy Policy, and to prevent harm to you or others.
User Information may be disclosed and transferred if Balance Hormone Center
or its business is sold or offered for sale to another company or person, if
a petition for relief under the United States Bankruptcy Laws is filed by or
against Balance Hormone Center, or if Balance Hormone Center becomes subject
to an order appointing a trustee or receiver.
If you email us, we will share your correspondence, including any User
Information in it, with the employees or representatives most capable of
addressing it. We retain your communication until we have provided a
complete response, and may retain it afterward for our records.

Except where we are compelled by law to disclose or retain your User
Information, you have the right to choose whether we disclose it to a third
party, whether we use it for a purpose incompatible with the purpose for which
it was provided, and whether we keep it. Contact us using the details below if
you wish to opt out of any such use. Opting out of certain third-party uses may
prevent us from providing the services you request.

4. Linking to third-party websites

When you click links in our Services that take you to third-party websites, you
become subject to those third parties’ privacy policies. While we support the
protection of privacy online, Balance Hormone Center cannot be responsible for
the actions of third-party websites. We encourage you to read the posted
privacy statement of every site you visit.

5. Accessing and managing your User Information

You can contact us to request the User Information we hold about you, and to
correct, amend, or delete it. We reserve the right to limit how often such a
request can be made, and to charge for responding if the process is misused. We
want the User Information we hold about you to be as complete and accurate as
possible, so please notify us if you believe any of it is inaccurate,
incomplete, or incompatible with the purpose for which it was provided.

6. Protecting your personally identifiable information

You have several options when deciding how best to protect your User
Information. One is simply not to volunteer it — you can still use our Services,
though this will prevent you from using some features such as requesting an
appointment. The Federal Trade Commission’s website,
www.ftc.gov, also offers
useful information about protecting information you provide to a website.

7. Suspected violations of this Privacy Policy

If at any time you believe Balance Hormone Center has not adhered to the
policies and principles set out here, please notify us using the contact
information below. We will make all commercially reasonable efforts to address
your concerns promptly.

8. Patient rights

If you are a patient of a Balance Hormone Center facility, you have additional
rights with respect to data within a designated record set, a term defined
under the Health Insurance Portability and Accountability Act of 1996
(“HIPAA”). For a complete description of a patient’s rights under HIPAA, please
refer to our Notice of Privacy Practices.

9. Changes to this Privacy Policy

This Privacy Policy was last modified on the date noted above. If we change it,
we will post the changes on this page so you are always aware of what
information we collect, how we use it, how we protect it, and under what
circumstances we disclose it. If we make material changes we will also post a
notice on our home page for seven consecutive days following the effective
date. Unless we clearly state otherwise, we will use information in accordance
with the Privacy Policy under which it was collected. Your continued use of our
Services constitutes your acceptance of the most recent version of this Privacy
Policy.
